Film Archive

1. The object of these terms and conditions is the use of the image, film and sound-recording material made available in the name of Salzgitter AG, Salzgitter.
2. When ordering image, film and sound-recording material from Salzgitter AG, Salzgitter, the user accepts that individual or several images, as well as film and/or sound sequences from the image, film and sound-recording material surrendered to the user, may only be utilized for editorial or journalistic reporting purposes.
3. Salzgitter AG owns all rights to the image, film and sound-recording material (property, copyright and right of use). Provided that it is used for editorial or journalistic reporting purposes, the image and film material utilized must always include a visible acknowledgement of the source of the information, namely the words “Salzgitter AG Archive”. Use of the image, film and sound-recording material that distorts the meaning, is discriminating or that damages the interests of Salzgitter AG, Salzgitter shall not be permitted. Any other utilization of the image, film and sound-recording material, particularly for advertising purposes, shall be expressly prohibited. The image, film and sound-recording material may not be forwarded to third parties. Any exceptions to this shall always require the prior written approval of Salzgitter AG, Salzgitter, Corporate Communications.
4. Printing and publication of the image, film and sound-recording material are free of charge. Salzgitter AG, Salzgitter, shall reserve the right to require that the user carry some of the costs for the transmission of the image, film and sound-recording material. In any case, in the event of publication, the user shall undertake to provide Salzgitter AG, Salzgitter with a specimen copy.
5. For making image, film and sound-recording material available free of charge, liability shall be excluded for deficiency of title and quality defects of the image, film and sound-recording material in particular for correctness, freedom from errors, freedom from industrial property and copyright rights of a third party or parties, completeness and/or usability – except for willful misconduct or fraudulent intent. If image, film and sound-recording material is sent electronically, Salzgitter AG shall strive to maintain the files free from viruses but does not guarantee freedom from viruses. Liability for damage caused as a result of viruses shall also be excluded, except for willful misconduct or fraudulent intent. For his/her own protection, the user must ensure that suitable security measures are taken and use virus scanners.
6. With regard to the collection, utilization and processing of personal data of the user, Salzgitter AG shall comply with applicable laws on data protection.
7. Supplementary agreements must be made in writing. If the user is a merchant in the sense of the German Commercial Code, the place of jurisdiction shall be Salzgitter. German law shall apply.
